Business Terms of Service

Welcome to Spotterly. These Business Terms of Service explain how businesses may use Spotterly to create profiles, publish promotions, and manage local offers.

By creating a business account or using Spotterly for a business, you agree to these Terms and to our Business Privacy Policy.

1. Authority to use Spotterly for a business

You confirm that you are authorized to create, manage, and publish promotions for the business you represent.

You agree to provide accurate business information, including business name, location, contact details, and promotion details.

2. What Spotterly provides

Spotterly provides tools that help businesses create, publish, and manage local promotional offers.

Spotterly does not guarantee:

• a specific number of views;
• a specific number of claims;
• sales;
• customer visits;
• revenue;
• business results.

3. Business responsibility for promotions

You are responsible for every promotion you publish.

You agree that each promotion must be:

• truthful;
• clear;
• lawful;
• not misleading;
• available as described;
• honoured according to the stated conditions.

You must clearly state important conditions, including expiry dates, quantity limits, eligibility limits, blackout dates, redemption instructions, and any restrictions.

4. No fake or misleading offers

You must not publish fake discounts, inflated prices, unavailable offers, bait-and-switch promotions, or promotions that create false urgency.

Spotterly may remove or reject promotions that appear misleading, unsafe, illegal, discriminatory, abusive, or inconsistent with the purpose of the platform.

5. Restricted or sensitive promotions

You are responsible for complying with all laws and regulations that apply to your business and your offers.

Spotterly may restrict or prohibit promotions involving regulated, age-restricted, unsafe, illegal, or sensitive goods or services.

6. Customer redemptions

If a consumer validly claims or redeems your offer, you are responsible for honouring it according to the published terms.

You are responsible for handling customer service, refunds, complaints, product issues, booking issues, and in-store experiences.

7. Business content

You confirm that you have the right to use any text, images, logos, trademarks, business information, or promotional material you upload or publish.

You grant Spotterly permission to display, reproduce, resize, format, and distribute your business content as needed to operate and promote the platform and your offers.

8. AI and image suggestions

Spotterly may provide AI-assisted text or image suggestions. These suggestions are optional drafts. You are responsible for reviewing, editing, and approving any content before publication.

You must not publish content that you do not have the right to use.

9. Fees and payments

Spotterly may charge fees for publishing promotions, using premium features, or accessing future business tools. Any fees will be shown before purchase or publication.

Unless otherwise stated, fees are not tied to a guaranteed business result.

10. Use of consumer information

You may receive limited consumer information to verify and manage offer redemptions.

You must not use consumer information for unrelated marketing, resale, profiling, or any purpose not permitted by law or by Spotterly.

11. Suspension or removal

Spotterly may suspend accounts, remove promotions, or limit access if we believe there is fraud, abuse, legal risk, consumer harm, non-compliance, or violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If changes are important, we will take reasonable steps to notify you. Continued use of Spotterly after changes means you accept the updated Terms.
